Asbestos Hazard Emergency Response Act (AHERA) Notification

Parents, Guardians, Faculty, Staff & Concerned Parties,

This notification is being made pursuant to the requirements of the Asbestos Hazard Emergency Response Act (AHERA) October 22, 1986; EPA Rule 40 CFR 763, Asbestos Containing Material in Schools, Subpart E, et seq. effective December 14, 1987. These regulations are defined in the United States Environmental Agencies Regulations. Specifically, 40 CFR §763.84 requires that we notify you at least once a year of asbestos inspections, response actions, and any post-response action activities, including periodic re-inspections and surveillance activities that are planned or in progress at our campus. Please reference the information below to learn more about our compliance with these requirements.

  • Dutchess BOCES has developed and maintains an Asbestos Management Plan for managing and maintaining the asbestos-containing building materials in-place and/or for their removal during future renovation activities. This plan includes documentation of all previous asbestos activities as well as our plan for upcoming work. The plan includes:
    • Current material lists
    • Findings of each 3-Year re-inspection
    • Documentation of each 6-month surveillance
  • The agency’s Designated Person for Asbestos is Mr. Brian Colandrea, Safety & Risk Coordinator
  • During the past twelve months the agency has completed several minor asbestos abatements.  All such work took place during periods when school was not in session.
  • For this coming school year, the following activities are planned:
    • Required periodic surveillances conducted by the Safety & Risk Department
    • The triennial re-inspection of all agency facilities shall be conducted in 2025
  • The Asbestos Management Plan is available for review upon request.
